Proposed Regulation

It is unlawful to take or attempt to take wild birds or bird eggs.

EXCEPTIONS:

  1. House Sparrows, European Starlings, and Rock Dove.
  2. RESERVED.
  3. In compliance with Code 09.15.
  4. In compliance with 50 CFR 21.12 Subparts A, B, C, D, E (50 CFR 21.1 - 50 CFR 21.61).
  5. RESERVED.
  6. AGFC employees while engaged in official duties or researchers, with written approval from Wildlife Management Division Chief, engaged in an AGFC supported research or monitoring project.

PENALTY: Class 1

Current Approved Regulation

It is unlawful to take or attempt to take wild birds or bird eggs.

EXCEPTIONS:

  1. House Sparrows, Red-Winged Blackbird, Common Grackle, Brewers Blackbird, Great-Tail Grackle, Brown Headed Cow Bird, European Starlings, Rock Dove, American Crow and Fish Crows.
  2. American Crows and Fish Crows (Code 05.01 and Addendum A1.07).
  3. In compliance with Code 09.15.
  4. In compliance with 50 CFR 21.12(b) and 50 CFR 21.43.
  5. Nuisance migratory birds taken in compliance with a U.S. Fish and Wildlife Service permit or regulation.

PENALTY: Class 1
